In the aftermath of a car accident, knowing what to do can be the difference between a smooth recovery and a legal nightmare. With Texas roads claiming 3,769 lives in 2025, according to the Texas Department of Transportation, the need for clear guidance is urgent. Gonzalez & Rothchild LLP (GoRo Law), a veteran-owned Houston law firm, is stepping up to provide that guidance, offering a list of steps drivers should take in the minutes and days following a crash.
"Most people have never been in a serious wreck, so they don't know what to do when it happens," said Ben Rothchild, a partner at the firm and a former Marine Corps Judge Advocate. "A few simple steps at the scene can make a big difference later, especially once an insurance company gets involved." The firm's recommendations are straightforward: call 911 and obtain a police report to create an official record; seek medical care immediately even if you feel fine, as some injuries manifest later; take photos of vehicles, damage, and road conditions; exchange information with all parties; avoid admitting fault or apologizing; and consult a lawyer before giving a recorded statement to insurers.
These steps are crucial because insurance adjusters are trained to minimize payouts. "Insurance adjusters are trained to keep payouts low. That's their job," said Edgar Gonzalez, a partner and former Coast Guard Judge Advocate. "We want people to know their rights before they sign anything or say anything on the record." Timing is equally critical in Texas, where most personal injury claims must be filed within two years. Waiting can jeopardize a case as evidence disappears and witnesses' memories fade.
Fault determination is another complex area. Texas follows a modified comparative fault rule, allowing recovery if the injured party is less than 51% responsible, but any award is reduced by their share of blame. "We see insurers push that fault number up all the time," Rothchild said. "If they can say you were half to blame, they can cut what they owe you in half, or pay nothing at all."
Rothchild and Gonzalez bring unique perspectives to their practice, having served as military Judge Advocates before transitioning to private practice and in-house roles. Their backgrounds shape how they prepare cases, offering clients a strategic advantage.
