CoorsTek Bioceramics, a leading supplier of implantable ceramic components for orthopaedic devices, has secured a significant legal victory that further establishes its right to market and sell its pink ceramic hip components in the European Union. The French Supreme Court ruled in favor of CoorsTek in its trademark dispute with CeramTec GmbH, upholding the cancellation of three CeramTec trademarks by the Paris court of appeal.
The Court held that CeramTec had filed for trademark protection of its pink components in bad faith, noting that at the time of the filing, CeramTec knew the pink color was not simply a brand indicator. This decision follows a recent ruling by the U.S. Supreme Court to decline review in a similar legal action, effectively ending CeramTec’s efforts to claim trademark rights to the color pink for ceramic hip components in the United States.
CoorsTek Bioceramics' Permallon® orthopaedic hip components, distinguished by their pink color, are now poised for broader market access across Europe. The company has emphasized that the color pink serves a functional purpose in identifying the ceramic material composition, rather than as a mere brand identifier. This argument was central to the court's finding that CeramTec's trademarks were invalid.
The implications of this ruling are substantial for the orthopaedic device industry. Surgeons and patients will have increased access to CoorsTek's high-performance ceramic components, which are known for their wear resistance and biocompatibility. The decision also reinforces the principle that functional colors cannot be monopolized through trademark law, potentially impacting other industries where color serves a functional role.
