David Resnick & Associates, P.C., a New York personal injury law firm, has obtained a $1,925,000 settlement before trial for a 38-year-old woman who suffered catastrophic injuries after slipping and falling on a wet and slippery staircase in her building. The settlement was announced by the firm, which represented the woman in the slip-and-fall lawsuit filed in the Supreme Court of the State of New York, New York County.
The woman alleged that the fall caused sustained tears in the labrum of both hips, as well as injuries to her spine and neck. Following the accident, she required surgery to repair the hip tears and was confined to rehabilitation services for several months. The injuries significantly impacted her ability to perform daily activities, including walking, bending, and sitting. She also could not complete household chores, sit or stand for long periods, or enjoy activities with her children.
The building owner and managing agent contended that the fall occurred during a period of snow and cold-weather precipitation, arguing they were not required to cover all floors with mats or continuously remove moisture tracked onto the stairs. They also asserted they did not create the wet conditions and lacked notice of them. However, attorney Philip Monier of David Resnick & Associates, P.C., who has represented accident victims for over 25 years, was prepared to call medical and economic experts to demonstrate the extent of the woman's injuries and their lasting effects.
"When an accident happens as a result of someone's negligence or failure to use reasonable care, the injured party deserves to be fully compensated not only for what that person has gone through since the date of the accident, but also for what the person will go through in the future, for the rest of that person's life," Monier said. "The proceeds from this settlement will help our client deal with her continuing pain and functional difficulties."
This settlement underscores the importance of holding property owners accountable for maintaining safe premises. Slip-and-fall accidents are a leading cause of injury, and victims often face long-term physical and financial challenges. The $1.925 million settlement will provide the woman with resources to cover medical expenses and lost quality of life.
