The woman alleged that the fall caused sustained tears in the labrum of both hips, as well as injuries to her spine and neck. Following the accident, she required surgery to repair the hip tears and was confined to rehabilitation services for several months. The injuries significantly impacted her ability to perform daily activities, including walking, bending, and sitting. She also could not complete household chores, sit or stand for long periods, or enjoy activities with her children.
The building owner and managing agent contended that the fall occurred during a period of snow and cold-weather precipitation, arguing they were not required to cover all floors with mats or continuously remove moisture tracked onto the stairs. They also asserted they did not create the wet conditions and lacked notice of them. "The proceeds from this settlement will help our client deal with her continuing pain and functional difficulties."
